Commercial Code section 2-725 deals with '[contracts] for sale' and, in definitional cross-references at the end of the section, makes reference to Commercial Code section 2106. Commercial Code section 2106 defines 'contract for sale' as including 'both a present sale of goods and a contract to sell goods at a future time.' In addition, the section defines 'present sale' as 'a sale which is accomplished by the making of the contract.' Since 'contract' is a key word in Commercial Code section 2106, illumination is provided by consulting Commercial Code section 1201, subdivision (11). This latter provision states that ''Contract' means the total legal obligation ...
