 As per Professor Farnsworth, in appropriate circumstances a memorandum made before the contract is formed can satisfy the statute of frauds, 2 Farnsworth on Contracts, supra, § 6.7, at p. 132 and n. 16, including the UCC statute of frauds. Under a general statute of frauds, 'it is well settled that a memorandum satisfying the Statute may be made before the contract is concluded.' Farrow v. Cahill, 214 U.S. App. D.C. 24, 663 F.2d 201, 209 (D.C. Cir. 1980) (footnote omitted).
