The requirements for admissibility of habit evidence are: The acts must be specific, routine, and continuous. Some courts add the requirement that they be invariable as well. A few states even require that the evidence be corroborated. Evidence relating to opinions or specific behavior is admissible. Reputation evidence is not allowed to prove habit or custom.
