Latin. That you have the body to submit to. A writ to the person detaining another and commanding that the person detained be brought before the court. This writ is used to determine the legality of custody of detention of a party. The reviewing court will look at the circumstances of how and why a party is in confinement and determine if that party has been afforded due process. This writ is guaranteed by Article I, Section 9 of the Constitution.
