The Court in Sanders v. United States, 373 U. S. 1 (1963) drew the phrase 'ends of justice' directly from the version of 28 U.S.C. § 2244 in effect in 1963. The provision, which then governed petitions filed by both federal and state prisoners, stated in relevant part that no federal judge 'shall be required to entertain an application for a writ of habeas corpus to inquire into the detention of a person . . . if it appears that the legality of such detention has been determined' by a federal court 'on a prior application for a writ of habeas corpus and ...
