A definite failure of issue means that there is a failure of issue at the death of the ancestor. The court must decide between a successive or substitutional construction of the definite failure of issue construction. A successive construction is one in which one person takes and another person takes in succession. A substitutional construction means that one person or another person will take the property but not in succession. If one person's interests become possessory, the other will never take.
