Facts

Young (D) drove a car in an area in which a number of bank robberies had occurred. Police watched D as he seemed to be casing several banks while driving his car around. They observed D using a device to monitor police calls and put on a knit stocking cap pulled over the top of his sunglasses. D approached a bank. D discovered that the door was locked and ran back to his car and drove away. D was stopped by police, and a loaded revolver was discovered inside his jacket. D was arrested, tried, and convicted of attempted robbery. D appealed, contending that the activities were insufficient for an attempt.
