Huey (D) was an assistant attorney general who was engaged in a conversation with Crary, attorney at law, in Crary's office. Without knocking or announcing his entry, Wishnatsky (P) attempted to enter Crary's office. D pushed the door closed pushing P back into the hall. P then reentered the office and D left. P then sued D for battery. D moved for summary judgment of dismissal, and it was granted. P appealed.
