Wille v. Southwestern Bell Telephone Company

219 Kan. 755, 549 P.2d 903 (1976)

Facts

Wille (P) entered into a contract with Southwestern (D) for a listing in the yellow pages. The contract limited liability for errors and omission to an amount equal to the cost of the advertisement. Of course, D screwed up and confused the phone numbers in the ad P had taken. P had to spend $4,500 on TV advertising to make up for the mistake. P sued for $9,900, and a summary judgment was entered in D's favor. P appealed.
