Walker v. State

63 Ala. 49 (1879).

Facts

Walker (D) used a large auger to drill a hole in the floor of a corncrib belonging to Woodruff and Peeples. Corn began to run through the hole once the auger was withdrawn. D was convicted of the burglary of 3 pecks of corn. D appealed: his act did not constitute the crime of burglary because he never entered the corncrib.
