U.S. v. Kayser-Roth Corporation U.S. D.C., R.I.,

724 F.Supp 15 (1989)

Facts

Stamina Mills, Inc. was a textile manufacturer in N. Smithfield, RI from 1952-75. It was located on the North side of the Branch River. Trichloroethylene (TCE) was used by Mills, and it was both dumped and spilled on the property. In 1982 EPA determined the Mills site was the source of the contaminant in the drinking water for the nearby Forestdale area. Kayser-Roth (D) was the corporate parent and sole shareholder of Mills. Pursuant to its dissolution plan in 1977, D received all of Mills' assets and assumed all liabilities and obligations.
