Facts

Spinner (D) was charged with two counts. Count, I was access device fraud under 18 U.S.C. 1029 (a)(5) and in Count II with bank fraud in violation of 18 U.S.C. 1344. D entered a plea of guilty to Count I and was sentenced to two years. This appeal followed.
