Hubert Ellis (H) was convicted of selling drugs on real property owned by his wife Evelyn (W). The U.S. sought forfeiture under 21 U.S.C. Section 881(a)(7). The District Court found that W had proved by a preponderance of the evidence that she had not consented to the drug activities by H. P appealed.
