Facts

Horn (D) was a sergeant in the Army and was stopped at by a Maryland State Trooper. D was suspected of DUI. Three standard field sobriety tests were issued, walk and turn, one leg, and horizontal gaze nystagmus test. Apparently D failed because he was charged with DUI. D filed a motion in limine to exclude the evidence in that it was inadmissible under FRE 702 and the Daubert/Kumho decisions.
