Facts

Estes (D) worked for Purolater as a driver-guard. One day he decided to invest in his own future and took $55,000 and returned home with the cash. D's wife Lydia was quickly informed of his new-found wealth, and they hid some of the money and spent the rest. D's wife helped hide and launder the money. D and Lydia were then divorced and eventually Lydia contacted the FBI and obtained a grant of immunity for herself and got tapes on D. Lydia testified before the grand jury and at D's trial. D was convicted of perjury and appealed.
