United States v. Downing

609 F.Supp 784 (E.D. Pa. 1985)

Facts

Downing (D) was accused of mail and wire fraud and the interstate transport of stolen goods. He wanted to introduce expert testimony at trial, but the court refused to allow it. The problem was that the proposed testimony was not generally accepted in the scientific community. D was convicted for fraud. On appeal, the Third Circuit rejected the general acceptance requirement and remanded the case for reconsideration of the issue of the expert testimony's admissibility.
