Tenhet v. Boswell

554 P.2d 330 (Cal. 1976)

Facts

Johnson and Tenhet were joint tenants. Johnson leased the property to Boswell (D) for 10 years at a rental of $150 per year with an option to purchase. Tenhet (P) was unaware of this arrangement. Johnson died three months after the signing of the lease. P sought to enforce its sole right to possession of the property as the surviving joint tenant. The court dismissed her action and P appealed.
