Facts

Stilk (P) was to be paid 5 pounds per month by the ships articles. During the voyage, two seamen deserted and the Captain agreed that each of the remaining crew should have the wages the two who had deserted would have earned. Those wages were to be divided equally among the reaming hands if the two seamen could not be replaced at Gottenburgh. P sued on the agreement when Myrick (D) refused to honor the agreement.
