Facts

W and H were married had a child and then separated. W has de facto custody of their ten-year-old daughter. W was diagnosed with metastasized renal cell carcinoma. W consulted three different specialists on how to inform her daughter of her medical problem. All three recommended that it was not the proper time and that the child should be prepared for the bad news. H recently informed W that if the child asked him he would tell the child the truth. W filed suit to enjoin H.
