State v. Williams

388 A.2d 500 (Me. 1978)

Facts

An unidentified person made a telephone call to a dispatcher in the Police Department and stated that a bomb was going to go off at the airport. It was recorded on magnetic tape. An officer listened to the tape and recognized the voice of D. D came to the police station later that day and read aloud a transcript of the threatening call previously recorded. A tape recording was made with D's agreement. The police then submitted the tapes to Dr. Tosi and Lt. Smrkovski for each to make a voice identification through the use of a speech spectrograph. Dr. Tosi testified as an expert at trial. Dr. Gertsman testified against allowing voice print analysis. The judge ruled that evidence admissible. Dr. Tosi and the Lt. testified that D was the person on the police call. Then the other officer who recognized the voice also testified that the voices were one and the same. D was convicted and appealed.
