Facts

Wallace (D) was cited in violation of a statute that prohibited using dogs to hunt deer or foxes. D was cited for a traffic violation for operating a motor vehicle while his dog was allegedly hunting a deer. D was convicted and appealed on constitutional grounds claiming that the statute denied due process because it did not define issues related to the natural instincts of dogs to hunt deer once they caught the scent even though the owner had no intention of that event ever happening.
