State v. Terrovona

Facts

Gene Patton, the decedent, received a phone call at his home. He told his girlfriend that the phone call was from Terrovona (D) and that apparently, D had run out of gas and wanted his assistance. The decedent also said that he must be crazy to help but left to do so anyway. Less than 15 minutes later a passerby found Patton's body alongside a car near where D said he had run out of gas. Patton had been severely beaten and shot. During trial, the trial court admitted this evidence. D was convicted and appealed.
