Facts

Virginia was charged and convicted of grand larceny. Virginia (D) was employed at a restaurant and had been discharged from employment. D and her then-boyfriend and soon to be husband visited the restaurant to obtain her final paycheck. They took $250 from the cash register. A witness reported to the employee on duty that his son had seen a young woman at the register with a stack of money bills in her hand. During trial, D testified about her prior life painting a rosy picture of bliss. The prosecution countered with evidence that D was a drug addict. D was convicted and appealed.
