Facts

Langis (D) and Carrier were traveling from Vancouver, B.C. to San Francisco. D stole a car in Eugene and drove to Roseburg. D said he intended to abandon the car there. D was caught and tried for larceny. The judge instructed the jury that an intent to deprive permanently could be found if abandonment occurred under such circumstances that recovery would be unlikely. D was convicted and appealed.
