Facts

Grugin (D) discovered that his son-in-law had sex with one of D's younger daughters. The son-in-law told D, 'I'll do as I damn please about it' when D confronted him. D killed the son-in-law in a heat of passion. D was convicted of second-degree murder. He appealed; the crime was manslaughter.
