Facts

The widow and legal representative of the minor children of the decedent appeared before the court and acknowledged receipt of financial satisfaction and payment of damages for the injuries sustained and in compromise and settlement of all civil causes of action arising from this incident. The death in question resulted solely from the negligence of D, and the widow requested that D not be prosecuted under the pending charge. The trial court dismissed the charges. The state appealed.
