State v. Dumlao

715 P.2d 822 (Hawaii 1986)

Facts

Dumlao (D) was extremely suspicious and suffered from chronic paranoia and delusions. During an incident caused by his paranoia, he shot and killed his mother-in-law. The court refused instructions that the homicide could be manslaughter if it was done while under the influence of an extreme mental or emotional disturbance for which there is a reasonable explanation. The reasonableness of the situation was to be determined from a person in the shoes of D. D was convicted of murder. D appealed.
