State Ex Rel. Indiana State Bar Association v. Indiana Real Estate Association, Inc.

244 IND. 214, 191 N.E.2D 711 (1963)

Facts

The Indiana State Bar Association (P) brought this action alleging that the use of forms of legal instruments by members of the Indiana State Bar Association (D), and the preparation of these forms by filling in blanks constitutes the unauthorized practice of law. D denied that they were giving legal advice in connection with the forms, and argued that the mere filling in of the blanks on the forms, which were prepared by members of the bar and were used by D pursuant to an earlier agreement with P, did not constitute the unauthorized practice of law.
