Silsbee v. Webber

Facts

Silsbee's (P) son was caught embezzling and signed a confession with Webber (D). P got involved, and D mentioned to P that he would have to inform the father (her husband). P's husband was known to be 'melancholy, very irritable, and unable to sleep. Knowledge of what had happened would have driven him insane. Under this 'duress' P signed a settlement agreement because she was afraid of what the incident would do to her husband. The verdict was directed for D in the lower court, and P appealed.
