Facts
H was unable to read or write. H entrusted W with the purchase of real estate on which H and W were then living. H relied on W to properly consummate the transaction. W without H’s knowledge or consent, procured the deed in her name alone as grantee and recorded that deed. H eventually learned 16 months later of the deception and demanded a conveyance to him. W refused. H sued W, his then ex-wife. Except for $525 received by W from her mother's estate, the property owned by the parties was largely the product of H's labor. When this property was acquired for $3,400, the sum of $2,000 received from the sale of other property and belonging to H was used, and the balance of the purchase price was paid principally out of funds belonging to W. The property is now worth $5,000. The court found that H was the owner of an undivided two-fifths of the property and that W held the title to such interest in trust for H. W appealed.
