Shute v. Shute

607 A.2d 890 (1992)

Facts

W was awarded custody of a minor son. H filed a motion alleging that his former wife denied him telephone and visitation contact since 1985. This began a two-year battle with H again filing a second motion for contempt and enforcement. The court then relinquished jurisdiction to the State of Connecticut as the Vermont court was an inconvenient court because Connecticut had been his home since 1982. H appealed that change in forum; he was denied reasonable notice and had no opportunity to be heard, and the court abused its discretion in that it did not look at all relevant factors in making its decision.
