Facts

Kathryn and D.N. Crabb were wife and husband. They were occupants in an airplane owned and piloted by D.N. when it crashed. Both died in the accident. P's petition alleged that Kathryn's death was the result of the negligent operation of the airplane on the part of D.N. P sought damages of $600,000. D moved for summary judgment asserting that interspousal tort immunity barred recovery. D's motion was sustained. P appealed.
