Seavey v. Drake

Facts

Seavey (P) alleged that his father gave a portion of his lands to P and that P took possession of those lands and occupied and improved them. P also claims that his father owed him $200 and that P gave up that note for additional land given by his father. D moved to dismiss P's bill because he stated not cause for equitable relief; the bill alleges a gift of land and a promise to give P a deed. The trial court refused to take P's evidence and dismissed the bill. P appealed.
