Facts

Sanders (P) and Pottlizer Bros. (D) engaged in a series of correspondence over the sale of 10 train cars full of apples. The parties finally reached an agreement by correspondence and then attempted to put that agreement in writing, and things did not progress so well as Pottlitzer kept adding additional terms when the contract was reduced to writing. The matter went to trial and D prevailed. P appealed.
