Facts

Sabella (P) was injured when he fell from the roof of a railroad car that he was cutting. P alleged that the fall was caused by D's negligent crane operator in moving the roof section and by the failure of D to provide a reasonably safe workplace. The jury gave the verdict to P. D moved for a new trial, and the trial court ruled that the evidence was insufficient to sustain the verdict. A new trial was denied on the condition that P would agree to remittitur. P agreed, and D appealed.
