Facts

Rubenstein (P) had an agreement with Kleven (D) to render companionship. P alleged that D breached that agreement and sued. D answered that the agreement was against public policy. P took D's deposition and asked certain questions relating to adultery to which D took the Fifth Amendment. P moved for an order compelling an answer.
