Rex v. Manley

Facts

D alleged that a man hit her with his fist, and took money from her. The allegation was false. D was charged on an indictment for basically making this false statement to the police. D plead not guilty. At trial, D presented no evidence but alleged that the indictment contained no offense known to law and that there was no cause to go to the jury. The judge instructed the jury on the offense of public mischief and that the offense in the indictment was a common law misdemeanor. D was convicted. This appeal resulted.
