Facts
Barnes was a deputy to Huggins (D), a prison warden. Unknown to D, Barnes placed a prisoner in a cell that was unsanitary. The prisoner died. Barnes and D were both indicted for murder. No evidence was introduced that D had any knowledge of Barnes' actions. The jury returned a special verdict finding that the death resulted from Barnes placing the prisoner in this unsanitary cell. Barnes was convicted of murder. The culpability of D is sought.
