Facts

Defendant Jones and Smith were apprehended early in the morning with two televisions owned by Smith's father that were reported stolen by Smith's father. Smith claimed that his father gave him permission to take the two televisions. It was the case that Smith had permission from his father to go into the house. Jones was charged and convicted of burglary.
