Facts

This was a consolidated case to consider the common issue of whether the New Orleans Civil Service Commission (CSC) erred as a matter of law by holding that because the New Orleans Police Department (NOPD) did not hold pre-termination hearings pursuant to CSC Rule IX, §1.2, the discipline imposed against the Ps, all NOPD officers, was illegal. Hurricane Katrina hit New Orleans, and a number of police officers simply abandoned their posts and or failed to report for work. The officers were terminated by NOPD without pre-termination hearings. The CSC affirmed that decision and D appealed.
