Facts

Donald Pritchard (P) alleged that his former wife, Zee (D), intercepted and used his telephone conversations by attaching a wiretapping device to the family phone. P claims that the conversations were recorded without his knowledge and consent. The District Court granted D's motion for failure to state a claim as there was interspousal immunity.
