Facts

Phillips (P) filed an employment discrimination claim against CIGNA's (D) based on race. D filed a motion to compel arbitration which P opposed as the arbitration policy was unilaterally implemented by D after P had already started employment and it was unenforceable under Title VII. P was an African-American female who was employed as D's Vice President, Fixed Income Research Analyst, in the Bloomfield Connecticut Office. P alleged that two of her supervisors embarked on a campaign to interfere and undermine her success as an employee. P's employment was eventually terminated. P was aware of the arbitration clause that was adopted by D after P's employment had already commenced.
