Facts

Salemme, the defendant, entered the Zimmerman home on two occasions with the intent to sell fraudulent securities. The defendant sold fraudulent securities on both occasions. Salemme was charged with two counts of burglary, two counts of selling unregistered securities, and two counts of selling securities by means of misleading statements and omissions of facts. The trial court set aside the burglary counts, claiming the purpose of burglary laws is to protect people against the dangers of intrusion.
