Facts
Khoury (D) placed various items of merchandise in an empty chandelier box and took it up to the check stand, intending to pay the price marked on the box. The cashier wanted to open the box to determine what was in the box. D left the box with the cashier. D was arrested and convicted of grand theft. D appealed; there was no carrying away.
