Facts

Castillo (D) and Rios were drinking at a bar. D got into an argument with Rios. D left the bar and returned an hour and a half later. D pointed a gun at Rios and said, 'I'll kill you,' and fired a fatal shot. D claimed voluntary intoxication. D was convicted and appealed.
