Facts
Audrey Parnell married Eldrigde Parnell (D), and he adopted her two children B and E in 1991. D forced B to have sex with E when B was 9 and E was 8. D was charged with sexual abuse in the first degree and sexual solicitation of a child less than 14. The charge was amended to include rape. D was convicted or rape and sexual abuse in the first degree. D appealed contending he could not be guilty of rape if the two children were not guilty of that crime.
