Facts

Park Place (P) is a broker of manufactured houses. P tried to arrange a number of sales of units in the P-K Park (D) but was prohibited from consummating the sales because D discriminated against children. P was joined by the Toledo Fair Housing Center, and the United States. D claims that its discrimination was protected as they provide housing for older persons and that 80% of its residents are over 55. The issue at trial was the full compliance with D of the regulations requiring significant facilities and services specifically designed to meet the physical or social needs of older persons.
