Pappas v. Bever

219 N.W.2d 720 (1974)

Facts

Bissonnette signed a form stating that he “intended” to give $5,000 to Charles City College. The form was filled in with the monetary amount and had been printed by P. It had terms for payment of the sum and Bissonnette’s signature. He did give P $1000 in both 1967 and ’68. The college closed in 1968. He gave no more money and died about a year later. P sued D for the remaining sums. The court held that the form by itself did not create a promise to pay. P appealed.
