Facts

Northern (P) entered into a contract with Bliss (D) to expand and modernize a steel fabricating plant owned by Phoenix Steel Corp. (P2). The total price of the contract was $27.5 million and the work extended over a 60-acre site. Work progressed slowly, and P wanted to compel D to hire 300 more workers for a second shift. The contract called for day and night shifts and D does not contest or deny that provision in the work contract. Ps sought relief from the courts for damages and an order for specific performance. The issue before the trial court was specific performance.
