Facts

The testatrix bequeathed the residue of her estate to her executors and their successors to be distributed to such persons, societies, or institutions that they may think most deserving. A dispute arose over whether this was a trust in the first place and whether if it was a trust was the beneficiary sufficiently described so the trust could be executed.
